NOTICE OF PRIVACY PRACTICES

THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU, INCLUDING RECORDS RELATING TO SUBSTANCE USE DISORDER (SUD) DIAGNOSIS, TREATMENT, OR REFERRAL, MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.
WHO WE ARE
Perma Health LLC provides healthcare services, including treatment for opioid use disorder using medications such as buprenorphine/Suboxone when clinically appropriate. Perma Health LLC is committed to protecting the privacy and confidentiality of your health information. This Notice applies to protected health information ("PHI") that we create, receive, or maintain about you, including substance use disorder records that may receive additional protection under federal law, including 42 CFR Part 2.
HOW WE MAY USE AND DISCLOSE YOUR HEALTH INFORMATION
- Treatment: We may use or share information with physicians, nurses, pharmacists, laboratories, specialists, counselors, therapists, and other healthcare professionals involved in your care.
- Payment: We may use or disclose information for billing, insurance verification, prior authorization, claims processing, payment collection, and other payment-related activities.
- Healthcare Operations: We may use information for activities necessary to operate our practice, including quality assessment, care coordination, licensing, compliance, credentialing, auditing, training, and administrative operations.
Substance use disorder records protected by 42 CFR Part 2 are subject to additional confidentiality requirements. When required by law, we will obtain your written consent before using or disclosing these records.
USES AND DISCLOSURES REQUIRING AUTHORIZATION
Except as described in this Notice or otherwise permitted or required by law, Perma Health LLC will not use or disclose your PHI without your written authorization or consent when one is required. Certain uses and disclosures may require specific written authorization or consent, including:
- Disclosures of substance use disorder records
- Uses or disclosures for marketing
- Sales of PHI
- Uses or disclosures of psychotherapy notes
- Uses or disclosures of SUD counseling notes
- Uses or disclosures in legal proceedings against you
You may revoke an authorization or consent in writing, except to the extent that Perma Health LLC has already acted in reliance upon it or as otherwise provided by law. We will not condition your treatment, payment, enrollment, or eligibility for benefits upon your signing an authorization except where permitted by law.
PSYCHOTHERAPY AND SUD COUNSELING NOTES
Certain psychotherapy notes and separately maintained SUD counseling notes receive heightened privacy protections. When applicable, Perma Health LLC will obtain specific authorization or consent before using or disclosing these notes unless the use or disclosure is otherwise permitted by law.
USES AND DISCLOSURES WITHOUT AUTHORIZATION
Depending on the circumstances and applicable law, Perma Health LLC may use or disclose PHI without your authorization for purposes including:
- Public health activities
- Health oversight activities
- Audits and investigations
- Judicial or administrative proceedings when legally authorized
- Medical emergencies
- Prevention of a serious and imminent threat to health or safety
- Reporting abuse, neglect, or domestic violence when authorized or required by law
- Certain research activities permitted by law
- Disclosures regarding deceased individuals
- Organ and tissue donation
- Certain specialized government functions
- Workers' compensation
- Other circumstances required or expressly permitted by law
Additional restrictions may apply to substance use disorder records protected by 42 CFR Part 2.
